Court Declines to Halt the Exchange
A federal judge refused to temporarily block the Trump administration from transferring more than 700 acres of a Texas wildlife refuge to SpaceX. Environmental and tribal groups had requested a preliminary injunction while their lawsuit against the land exchange proceeds.
U.S. District Judge Fernando Rodriguez Jr. said the plaintiffs did not show that the transaction would worsen ecological risks during the case. He characterized their evidence of environmental harm as relatively weak. The judge also found that an injunction could disrupt SpaceX’s development plans and contractual obligations.
Terms of the Federal Land Swap
The deal approved in June requires SpaceX to surrender 683 acres it owns. In return, the company would receive federal land within the Lower Rio Grande Valley National Wildlife Refuge. The 103,000-acre refuge extends across four Texas counties and contains animal habitats and historical landmarks.
Maps indicate that the property SpaceX would acquire sits closer to its launchpad near the U.S.-Mexico border. The U.S. Fish and Wildlife Service concluded in its final environmental assessment that the exchange would have no significant impact on the area.
Federal officials have argued that acquiring the company’s land would create a net conservation benefit. According to the assessment, the transaction would provide long-term conservation value and improve habitat connections among refuges in South Texas.
Opponents Continue Their Legal Challenge
Conservation advocates describe the exchange as a transfer of public land for private benefit. The Center for Biological Diversity filed the lawsuit with other opponents, including tribal groups. Its spokesperson, Laiken Jordahl, said the litigation would continue even if the exchange moves forward.
Local critics have also raised concerns about reduced beach access and the environmental effects of rocket explosions. They say the land has spiritual, historical, and conservation value. SpaceX and the Fish and Wildlife Service did not comment on the judge’s decision.
The ruling represents an interim decision rather than the end of the case. SpaceX has expanded rapidly in South Texas since first breaking ground there more than a decade ago. Its employees also voted last year to establish a local government called Starbase.
