Appealing the Second Block
Currently, the Trump administration is appealing a federal judge’s ruling that blocked significant limitations on mail voting. Specifically, the Justice Department formally notified the U.S. District Court for the District of Massachusetts of its appeal to the 1st Circuit Court of Appeals. This notice comes just hours after U.S. District Judge Indira Talwani handed down a new decision temporarily blocking the implementation of President Donald Trump’s executive order for the next two weeks. Earlier in the week, the Supreme Court had actually allowed the plan to move ahead on procedural grounds, ruling that an initial injunction was premature. Therefore, this whipsawing legal battle creates intense uncertainty just days before the first states begin sending out mail ballots for the pivotal November midterm elections.
Executive Order Directives and State Challenges
Under Trump’s controversial executive order issued in March, the U.S. Postal Service (USPS) could refuse to deliver mail ballots from states that do not comply with new regulations. Specifically, states would be required to submit lists of eligible voters via a federal portal and follow uniform envelope styles, including specific barcodes. The White House defends the plan as a set of commonsense measures aimed at protecting ballot security and eliminating fraud. Conversely, Democrats, voting rights groups, and nearly two dozen states argue the executive order is unconstitutional. They note that the Constitution grants states and Congress the explicit power to make election rules, not the president or the Postal Service.
Impending Midterm Deadlines
Furthermore, Judge Talwani found that states currently lack the time and money necessary to design new ballots, update processing systems, and train local officials to comply with the USPS directives before the midterms. In fact, the first mail ballots to determine control of Congress are scheduled to be sent out on September 4. Meanwhile, Celina Stewart, CEO of the League of Women Voters, expressed confidence that the law favors the plaintiffs. Ultimately, because nearly one-third of Americans rely on mail voting, the final outcome of this high-stakes appellate battle could have massive ramifications for the upcoming general election.
