ISLAMABAD — A Hague international arbitration panel ruled on Monday that India must respect a decades-old water treaty with Pakistan. Following a formal request by Islamabad, the tribunal prohibited India from pouring concrete above specified levels at the Ratle hydroelectric project in disputed Kashmir. Consequently, these restrictions will remain active while a World Bank neutral expert evaluates whether the project complies with the water treaty. Pakistan celebrated the legal ruling as a major diplomatic victory, while New Delhi rejected the tribunal’s authority.
Hague Ruling Upholds Legal Binding of the Water Treaty
The Permanent Court of Arbitration clarified that the historic 1960 water treaty remains legally binding and contains no provisions allowing unilateral suspension. Furthermore, the panel rejected India’s arguments regarding security, climate change, and regional population growth, asserting that such factors do not justify abandoning an international agreement. Therefore, the court ruled that India must continue fulfilling its obligations, including strict design limits on hydroelectric projects built along western rivers flowing into Pakistan.
Escalating Regional Tensions and the Future of Cooperation
The dispute follows India’s decision to suspend the water treaty after a 2025 militant attack in Kashmir, which sparked severe border clashes between the nuclear-armed neighbors. However, the tribunal concluded that security allegations do not constitute a breach of the water agreement itself. While Islamabad hopes the ruling will restore bilateral dialogue, New Delhi maintains that the tribunal was illegally constituted. Nevertheless, experts emphasize that preserving this water treaty remains vital for agricultural stability and long-term security in South Asia.
